2. Scope
These Terms and Conditions apply to the SoyleStories mobile application and the related digital services (story generation as text, optional images, and optional narration), including entitlements (coins and subscriptions).
3. Language / prevailing version
These Terms are provided in German and English. In the event of discrepancies, the German version shall prevail.
4. Service description
SoyleStories enables users to create stories with optional illustrations and optional narration (text-to-speech) based on user input and templates/macros.
Generated content is delivered to the user. To ensure reliable delivery, temporary server-side cache storage may be used. For signed-in users, the service may also retain archived story text and related metadata on the server to support history restore, cross-device synchronization, and recovery after reinstall or cache cleanup. Original generated image and audio files are not part of this archived store and may be removed through acknowledgement or operational cleanup.
The Provider may reasonably develop and update features, provided that core contractual obligations are not materially undermined.
5. Free usage allowance
The app may from time to time provide promotional or free usage allowances.
Any such allowance is configuration-based, may change over time, and is only available if explicitly shown in the app for the relevant user account.
Unless the app explicitly displays such an allowance, generation requires the applicable paid entitlement in accordance with Section 6.
6. Paid features (coins and subscription)
Coins: Image/illustration generation and narration (text-to-speech) require coins. Coins are sold in packs via the applicable app store.
Subscription: A subscription enables text-story generation in accordance with the applicable subscription terms. Images and narration are not included in the subscription and require coins unless explicitly stated otherwise in the app.
Fair use: To ensure stable operation, the Provider may apply fair-use limits per account and time period, including for subscribed users.
If there is no free quota available and the user does not have sufficient coins or an active subscription, generation features may be unavailable.
7. Prices, billing, refunds, taxes
Prices may vary by region and store account. The final, binding prices are shown at checkout in the app store.
Payment processing, receipts, subscription renewal/cancellation, taxes/VAT handling (where applicable), and store-specific conditions are handled by the applicable app store.
Refunds for purchases (coin packs/subscriptions) are governed by the applicable app-store rules and processes.
8. Contract formation
A contract for paid services is concluded when the user confirms the purchase/subscription in the app store and the app store confirms the transaction.
The Provider verifies entitlements based on information received from the app store and/or technical interfaces (for example, tokens or status responses).
9. Right of withdrawal (consumers)
Consumers generally have statutory withdrawal rights.
For digital content/services, withdrawal rights may expire early under statutory conditions (for example, after explicit consent to immediate performance, where applicable).
10. Term and cancellation
Subscription term and auto-renewal are governed by the app-store conditions.
Cancellation is managed via the app store and takes effect at the end of the current billing period.
11. Availability
The Provider aims for high availability but does not guarantee uninterrupted availability.
Maintenance, network issues, device issues, or upstream/provider outages may affect functionality.
12. User obligations and prohibited content
Users are responsible for submitted content (prompts, names, text) and must ensure they have the necessary rights to use any content they provide.
Users must not request or submit unlawful content or content that infringes third-party rights (for example, copyright, trademarks, or personality rights).
Safety filters of third-party providers may apply and are not fully under the Provider's control.
13. Suspension and termination
The Provider may temporarily suspend or restrict access (including generation features and/or accounts) if:
- misuse, unlawful content requests, fraud, or abuse is suspected,
- technical security reasons require it, or
- required entitlements are not available.
The Provider may terminate the contract for cause in accordance with statutory requirements.
14. AI output / no guarantee of success
Generated content is produced by automated AI systems. No guarantee is made regarding correctness, completeness, fitness for a particular purpose, or uniqueness.
Users should review generated output before any further use or publication.
15. Coin charging and failure cases
Coins are charged only for successful image or narration generation as determined by the server-side success logic.
If image or narration generation fails, no coins are charged for the failed result.
16. Rights in generated content
The Provider is not the author of generated content.
To the extent the Provider can grant rights, the user receives a simple (non-exclusive), worldwide, perpetual right to use the generated content.
No exclusivity is guaranteed; similar content may be generated for other users.
Users remain responsible for checking third-party rights (including copyright, trademark, and personality rights) before publication or commercial use.
17. Age requirements
Purchases/subscriptions require legal adulthood (18+) or consent of a legal guardian.
SoyleStories is intended for family use; purchases should be made by adults.
18. Liability
Unlimited liability applies in cases of intent, gross negligence, and injury to life, body, or health.
In cases of slight negligence relating to essential contractual obligations, liability is limited to the typical foreseeable damage.
Otherwise, liability is excluded to the extent permitted by law; mandatory statutory liability remains unaffected.
19. Privacy
Information on personal data processing, including Android app analytics/campaign measurement and iOS SKAdNetwork attribution, is provided in the Privacy Policy:

20. Consumer dispute resolution (ADR)
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle), unless a legal obligation applies in a specific case. Information duties under German consumer dispute resolution law (VSBG) remain unaffected. (Note: The EU ODR platform was discontinued as of 20 July 2025.)
21. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protections of the user's habitual residence remain unaffected.
If any provision is invalid, the remaining provisions shall remain in effect.
